Translatus Language Services Ltd. values your privacy. Translatus Language Services Ltd. has fully implemented the General Data Protection Regulation (GDPR), a European Union law. Please read our Privacy Policy carefully, to find out how we collect, process and store the information you provide to us via our contact form or an enquiry form on our website. What information does Translatus Language Services Ltd. collect?

When you use our website, we collect your information/data. For example, when you provide us with your personal information in the "Contact Us" or "Ask for a Quote" forms. We may also collect information about your access device and the IP address from which you accessed our site. When you use the above-mentioned forms, we receive information directly from you, such as your name, e-mail address, business or home address, and telephone number, in order to provide you with the service/services you have requested. The information is provided either by you personally or by the company you represent.

How do we use your information?

When you provide us with your data, we can use the information we receive, for example, to respond to your inquiry in the “Contact us” form. We also use the information to administer and improve the website and for analysis purposes, to monitor our marketing activities, i.e. the popularity of certain parts of our website or site.

If you use our services, we may use your information in the following ways:

  • We use the information to provide the necessary communication for the purpose of your request for a particular service/services. For example, if you submit a request via the contact form or other forms, Translatus Language Services Ltd. may collect personal information obtained for the purpose of continuing communications for commercial cooperation.
  • We may also use your information to contact you and respond to your enquiry via the “Contact us” form or  “Request a quote” form, to provide you with a quotation.
  • We also use personal information when a user visits our website and clicks on a particular page item. In this case, anonymous information about the visit of certain sub-pages of our website is collected (Google Analytics tools).

Cooperation with third parties

We do not rent or sell your personal data to third parties. We do not share any personal information of our users or potential users of our services with third parties. Our employees have no right to use personal information collected for the purposes of cooperation between users of our services and Translatus Language Services Ltd.. Although it is unlikely, in case of a court order from the authorised legislative bodies, Translatus Language Services Ltd. may be required to provide them with the requested information. Translatus Language Services Ltd. will take precautions to ensure that the authorised bodies have a valid reason for the requested information.

Security and privacy

Translatus Language Services Ltd. protects personal information from unauthorized access and disposition. Translatus Language Services Ltd. implements organizational, technical and physical security measures to protect the collected personal information.

The information provided by appropriate cookies helps us to understand how our users use the site. In this way, we can improve the quality of content for users and the browsing experience. Access and update your personal information

To review or update your personal information and to ensure that it is accurate, please contact us at info@translatus.hr. Translatus Language Services Ltd. will make every effort to provide you with the required information within 30 days of requesting access. Your information may be updated, changed or completely deleted if necessary. If, for any reason, we are unable to fulfil your request within 30 days, you will be notified as soon as the information is provided. Although it is unlikely that we will not be able to provide you with the information you have requested, you will be informed of the reason why we cannot provide the requested information.

Any inquiry or complaint regarding privacy will be recorded and investigated. In addition, the results of the investigation will be secured. General Terms and Conditions

General information

These General Terms and Conditions apply to all contracts for language services between us (Translatus Language Services Ltd.), the contractor and our clients, unless otherwise agreed in writing. The General Terms and Conditions shall be accepted by the customer, or our clients when placing the order and apply for the entire duration of the business relationship. Other general terms of service, contracts, terms of delivery or similar business rules shall be binding on only if we expressly agree to them in writing.

Our services

We provide the customer (i.e. our clients) with high quality translation and other language services. We carry out the orders properly, quickly and with the greatest possible care.

The information and documents required to achieve quality translation must be provided to us by the client on time and without explicitly requesting them.

Special terminology as requested by a translation client will only be used if this is stated when ordering the service, or if a client makes available his specific glossaries, illustrations, tables, abbreviations, etc.

We, as the service provider, reserve the right to ask a client for clarification in the original text. However, we may also choose to translate vague or unclear parts of the text to the best of our knowledge in accordance with what seems to us to be their true meaning and / or how they are commonly translated.

Confidentiality

All texts, documents and information provided by the Client shall be treated as strictly confidential and shall be made available without prior consultation only to those persons who are directly involved in the translation or other language services -  unless that information is published in a publicly available publication or is commonly known in industry and business.

We undertake to keep confidential all the facts that become known to us while providing customer services. Our employees are bound by confidentiality, and sign a confidentiality agreement with us. Translatus Language Services Ltd. will not be responsible for the disclosure or use of information already provided to third parties or the public, which will be published in the future or which are legally binding under a warrant issued by a competent judicial authority.

The Client shall provide his personal data and/or the data of the company he represents in order to ensure that the translations can be properly invoiced, billed and entered into our translation and other language project management system. Also keep in mind our Privacy Policy.

Order Placement

The client or customer places translation, editing and localization orders and all other language-related orders with us in electronic form via the Internet. This is done using our language project management system, via email or any other form. The client also submits all the files needed to complete a particular order online, our language project management system, email, or any other form..

The client can decide whether he/she wants to place an order for the service(s) immediately or first obtain a quotation. Such a quotation is usually sent to the customer within a few hours, usually within twelve (at the latest twenty-four) hours.

A formal quotation can only be made once the client has submitted all the documents or files to be translated and all additional services have been described in detail.

Acceptance of the service or delivery, including partial deliveries, is a primary obligation of the customer. If the customer refuses or fails to accept the service or delivery, he is in default of acceptance without further reminder and is liable for all damages incurred.

All times stated refer to Central European Time.

The text sent by the client or customer via the Internet or the transmission of the relevant files will be confirmed by us in writing. An order shall only be deemed to have been accepted if we have confirmed it in writing.

We shall not be liable for delays or deficiencies in execution that arise due to incorrect or incomplete transmission of the source text or due to misleading or incorrect wording in the source text.

The data received from the customer in connection with the order or the translation itself, which is available as a file, remains with Translatus Language Services Ltd for archiving purposes. This data will only be deleted at the express request of the customer/client.

The client/customer agrees that Translatus Language Services Ltd. may use subcontractors to provide certain partial services.

Third-party rights

The client or customer shall ensure that no rights of third parties to the information, documents and other items transmitted to us prevent the processing, exploitation, reproduction or publication of the processing. The client/customer shall indemnify us, our employees, our subcontractors from any liability for claims of third parties based on the use, processing, exploitation or reproduction of documents, information and other items or their processing.

Compensation

All services will be invoiced according to our set fees or price list valid at the time the order is placed, unless otherwise agreed in writing. In short texts, the minimum order fee must be observed.

The fees (prices) are in HRK, for foreign clients Euro, unless a different currency has been agreed. All prices are net prices, and exclusive of VAT.

The price calculation for translations is usually based on the length of the original text, so the price can be determined in advance. Unless otherwise agreed with the client, the price calculation is based on a single word unit. The calculation is done using special software that determines and calculates the number of words in a given text.

Translations can also be calculated on the basis of lines or pages of the translated text, if so agreed with the client. 1 line = approx. 40 characters (without spaces) or 50 to 55 characters (with spaces), 1 page (DIN A4) = approx. 25 lines.

For large orders, a deposit or payment in instalments according to the amount of text completed may be requested. Private individuals may be required to pay the full order amount in advance.

We reserve the right to charge the full translation price for editing and/or proofreading of translations made by translators not employed by us, if these translations are of inferior quality, and the provision of these services requires as much time and effort as the translation service itself.

The cost of a written translation incudes: finding and choosing the appropriate terminology, agreeing with the client the translation of professional terms and the terminology used by the client, translation, entry of a text in a particular word processor or typing in an existing source file, checking your own translation, proofreading by a proofreader and a final check before delivery.

In case of interpretation, consecutive or simultaneous translation, the time spent by the interpreter at the client's premises from the moment the interpreter arrives at the place where the client has ordered the interpreter until the end of the meeting (conference) is counted towards the payment of the interpreting fee, regardless of the time spent on the actual interpreting service.

In case of cancellation of an order, work already completed shall be made available and invoiced.

All offers and prices are subject to change without previous notice.

Delivery

We will inform the client of the delivery time of the translation as precisely as possible.

Delivery dates shall only become binding once they have been confirmed by us.

If, for unforeseen reasons, the accepted order cannot be completed within the agreed time, the client or translation service will be immediately notified of the delay. We will only accept cost reductions for our services after the agreed extra time period or reasonable additional time required to complete the work has been exceeded. After the expiration of this second deadline, the client of the translation or service may refuse to accept our services.

In case of force majeure, a delay in the provision of services is justified in proportion to the duration of the circumstances caused by the force majeure. In this case, a later delivery date is agreed. Force majeure cases are in particular: natural disasters, adverse weather conditions that prevent employees from coming to work, war and military actions, strikes, protests, fires, floods, power and internet failures, epidemics, etc.

Payment

Deadline for payment for services provided by Translatus Language Services Ltd. is fourteen days after invoicing (thirty days at the latest), unless a different payment deadline has been agreed in advance. In case of late payment, we as the service provider, shall charge default interest and other legally allowed fees in addition to the amount due.

If the invoice amount is paid by credit card, the client shall will emphasize such a payment method when ordering, and will provide us with the name of the company, the bank that issued the credit card, the credit card number, the expiry date of the credit card, and to whom the credit card is addressed. The client may forward this information via an online form, by email or fax. By ordering this type of payment, the customer authorizes us to make the payment of the invoice by a credit card.

Liability

Please let us know as soon as possible if any problems or irregularities concerning our business cooperation arise in order to find a solution to our mutual satisfaction.

Complaints shall be accepted only if they have been submitted in writing, in case of obvious deficiencies, immediately after delivery of the translation or after the service has been provided, giving a detailed description of the deficiency; for obvious defects, this must be done immediately after checking the translation or service; for hidden defects immediately after the client becomes aware of the defect

All complaints in the case of obvious defects must be submitted within a period of fourteen days after delivery of the translation or service rendered, and in the case of hidden defects within a period of fourteen days after the client has become aware of those defects.

If a client has duly reported and explained the objection, we will, in our estimation, either correct the existing translation or service or replace it with a new one, or offer a price reduction or revision of the contract or order. If a translation correction or a new translation does not correct the flaw of a first translation, a right to a price reduction or a contract revision, orders will be renewed.

We, Translatus Language Services Ltd., are not responsible for errors caused by incorrect or incomplete information or incorrect or illegible texts or documents submitted for translation.

We accept no responsibility for defects in translations of difficult to read, illegible or incomprehensible documents.

Stylistic improvements or adjustments to certain terminology (especially terms specific to an industry or a particular company), abbreviations, etc. that have not been defined and explained by a client when ordering will not be recognized as translation errors.

Services performed on an emergency basis are not subject to the right of objection.

To ensure the best possible protection of data and information in the electronic transmission of texts and data, we use the latest IT technology to protect your data from access, misuse, loss, destruction and alteration by third parties.

Instantly, when you fill out our online forms and submit them to us, we use the so-called SSL protocol (encryption method for secure online data transfer) on our web pages to protect your data and secure your transactions. SSL encencrypts all of your personal data, including your credit card number, name and address during data transmission over the Internet.

No online data transfer is 100% secure and Translatus Language Services Ltd. cannot guarantee the absolute security when transferring your information. In the event that a client considers their documents to be strictly confidential, we recommend that such documents be delivered directly to our office.

We are not liable for the consequences of force majeure and unavoidable natural events.

Further claims are excluded from us as well as our employees, representatives and assistants.

All claims for compensation against us as service providers are limited to the value of the particular service or to the (net) invoice amount, unless otherwise provided by law. There is no liability for lost profits or consequential damages.

References

Translatus Language Services Ltd. reserves the right to publish the client's name on the Translatus Language Services Ltd. website and other promotional materials for reference. Translatus Language Services Ltd. waives this right if the customer objects to this in writing.

Copyright

Translatus Language Services Ltd. as a language service provider retains its copyright on translations and all glossaries, terminology lists etc. derived from them. This also applies to translations made with the aid of so-called CAT tools.

Other provisions

The translation remains the property of the translator until full payment has been received. Until then the client has no right to use such a translation.

The client will be notified in writing of any changes to the General Terms and Conditions. They shall be deemed to have been approved if the client does not object to them in writing within two weeks of notification.

Severability clause

Should any of the aforementioned provisions of these General Terms and Conditions be or become invalid or ineffective, this shall not affect the validity of the other provisions. In this case, the invalid or ineffective provision shall be replaced by a provision which comes as close as possible to the purpose of the invalid or ineffective provision.

Jurisdiction

The law of the Republic of Croatia shall apply.

The jurisdiction of the competent court in Zagreb shall apply to all disputes arising from these General Terms and Conditions.
